2. Platform as a Technology Facilitator

MahaMarketplace is a technology facilitator that connects vendors, buyers, affiliates, and service providers. MahaMarketplace does not directly sell or provide any products or services. The platform merely enables transactions between the various parties.

Liability: All liability related to product or service quality, delivery, customer support, safety, and any other responsibilities rest solely with the respective vendor or service provider. MahaMarketplace is not liable for any issues arising from disputes between buyers and sellers, or service providers and clients.

No Warranty: MahaMarketplace makes no warranties, either express or implied, regarding any products or services sold or offered through the platform. MahaMarketplace is not responsible for the accuracy of product descriptions, service qualifications, or other content provided by vendors or service providers.

3. User Roles and Responsibilities

3.1 Vendors

•Vendors are responsible for complying with all local, state, and national laws in the provision of their products or services.

•Vendors must ensure that their products or services are accurately represented and adhere to all legal standards of safety and quality.

•Vendors agree that MahaMarketplace will deduct an agreed-upon commission from the sale proceeds.

3.2 Affiliates

•Affiliates promote products and services listed on MahaMarketplace and earn commissions for sales generated through their promotional efforts.

•Affiliates are responsible for compliance with applicable advertising laws and must not make false or misleading statements about the products or services.

•Affiliates are not employees of MahaMarketplace and are considered independent contractors.

3.3 Buyers/Users

•Buyers must provide accurate payment and delivery information when purchasing through the platform.

•Buyers are responsible for reviewing product or service descriptions, vendor policies, and terms before making a purchase.

3.4 Service Providers (Instructors, Physiotherapists, etc.)

•Service providers offering consultations or services through MahaMarketplace are responsible for ensuring that their qualifications, licenses, and certifications are up-to-date and accurate.

•All liabilities arising from the services provided rest with the service provider. MahaMarketplace assumes no liability for any advice, treatment, or services rendered by these professionals.

4. Payments and Fees

•Payments are processed through third-party services integrated with MahaMarketplace.

•MahaMarketplace collects a commission from each transaction as per the agreed rates with vendors, affiliates, and service providers.

5. Refunds and Disputes

•Vendors and service providers must specify their refund and return policies.

•Buyers or users experiencing issues with a product or service must resolve the issue directly with the vendor or service provider. MahaMarketplace may assist with dispute resolution but is not liable for resolving disputes.

6. Termination

MahaMarketplace reserves the right to terminate or suspend any user’s access to the platform at its sole discretion, including for breaches of these Terms and Conditions or legal violations.

7. Limitation of Liability

MahaMarketplace is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of the platform, including but not limited to product defects, service provider misconduct, or technical issues with the platform.

8. Governing Law

These Terms and Conditions are governed by the laws of the state where MahaMarketplace operates. Any disputes will be resolved in accordance with the applicable jurisdiction’s laws.

10. Termination for Violations, Malpractice, or Any Reason

MahaMarketplace reserves the right to terminate or suspend any user’s access to the platform, including vendors, affiliates, buyers, and service providers, at its sole discretion and for any reason or no reason at all, including but not limited to:

Violation of these Terms and Conditions.

Negative feedback or reviews that reflect poor service or product quality.

Malpractice, fraudulent activities, or any actions deemed harmful to the platform’s reputation or user safety.

Non-compliance with applicable laws, regulations, or insurance requirements.
